“Every conflict deserves a customised solution. In addition to traditional litigation practice, I also firmly believe in a connecting approach. In addition to working as a lawyer, I’m also an MfN registered mediator. Two roles that suit me perfectly, despite their contradictions. With my sincere interest in the underlying conflict and my investment in the relationship, I give parties the confidence that they’re in good hands. As a lawyer, I determine the approach I take on a case-by-case basis, naturally with my client’s interests at heart. As a mediator, it’s simple: I’m impartial and follow the approach that is appropriate for an MfN registered mediator and that fits my personality.”
Jolanda de Groot has been an employment lawyer since 2002 and, more recently, an MfN registered mediator. These two roles are in fact polar opposites. As a lawyer, she’s partial; as a mediator, she’s impartial. Jolanda regards this as an exciting challenge and a welcome change in her daily practice.
As a lawyer, she deals with employment law in a broad sense. She has a wide-ranging advisory and litigation practice and often advises employers as well as senior employees. This includes reorganisations, dismissal cases, supervising improvement processes, employee participation, formal directors, issues relating to employment conditions (and their implementation or amendment), flexible employment relationships, and cross-border employment (including immigration and secondment issues).
Jolanda is furthermore an MfN-registered mediator. Her genuine interest in the people around the table helps them to engage in open and honest dialogue in a safe and confidential setting. This often leads to a discussion of interests rather than a stalemate based on positions. The aim is to find a sustainable solution that represents both parties’ interests. Jolanda can be called on for employment law issues such as a current or imminent labour dispute concerning mutual cooperation with colleagues or managers, between directors, with a works council, concerning an employee’s performance, or incapacity for work. She can also play a role in international relations, because the mediation can take place in English and she is sensitive to any cultural differences. Conflicts in the business services sector, between the company and its suppliers or other partners, are also suitable for mediation.
With Jolanda, what you see is what you get. Her personal and dedicated approach inspires confidence, and her quick thinking is characteristic of her style. Jolanda has long-standing relationships with her clients. This means that she’s not only a conflict resolver for her clients, but also a sparring partner who is called on at various stages of projects in the areas of HR, employment law or organisational matters within the company.
Jolanda completed the PALA (Postgraduate Employment Law Course) cum laude in 2007. She’s a member of the Dutch Association of Employment Lawyers (VAAN), the Employment Law Association (VvA) and the Dutch Association of Mediation Lawyers (NVVMA). She’s also registered as an employment law specialist in the Dutch Bar Association’s Register of Legal Areas and is listed in the MfN register of accredited mediators. Jolanda practises in Dutch and English.
