Monica van Ruitenbeek-Kossen is a specialist in the field of corporate law and insolvency law, with an emphasis on restructuring, financing and security. Her expertise brings together two worlds she is passionate about: law and entrepreneurship. In order to provide her clients with the best possible assistance, she considers it essential to have a thorough understanding not only of the client’s business, but also of the client itself. If a company is in financial difficulty, restructuring can allow it to continue operating in a slimmed-down version. On the other hand, for a successful company with a new round of financing, restructuring can provide the new ‘room to manoeuvre’ to move towards a bright future.

Monica is a trustee and is regularly appointed by the District Court of Noord-Holland as a trustee in insolvency cases. Her background as a trustee makes her well equipped also to represent the other side, alongside a director, entrepreneur or creditor who is unexpectedly faced with insolvency, or a potential restarting entrepreneur who sees opportunities in an insolvent company. Monica also regularly litigates in the field of directors’ and officers’ liability and actio pauliana (applications to set aside fraudulent preference).
Monica studied both Law and Business Administration, specialising in Corporate Law. She later supplemented her knowledge with courses in Insolvency Law for Trustees, Grotius Insolad, and Financial Economics for Insolvency Lawyers. In the past, she was also a member of the development group for the Ministry of Security and Justice’s Guidelines for Combating Insolvency Fraud.
