If we have asked for and obtained your consent, you have the right to withdraw that consent at any time. You may do so by contacting us.  <\/p>\n<p>On the basis of this legal ground, we process your personal data for the following purposes:<\/p>\n<ul>\n<li>In the context of marketing activities, we never process special categories of personal data or personal data protected by legal professional privilege;<\/li>\n<li>the compilation of user statistics.<\/li>\n<\/ul>\n<p><u>Necessary for the performance of the agreement<\/u><\/p>\n<p>If you instruct us to provide legal services, we will process personal data insofar as this is necessary for the performance of the agreement with you.<\/p>\n<p>On the basis of this legal ground, we process your personal data for the following purposes:<\/p>\n<ul>\n<li>the provision of legal services and the conduct of legal proceedings;<\/li>\n<li>to invoice for services rendered and to collect outstanding fees;<\/li>\n<li>to maintain contact with you; and<\/li>\n<li>to conduct client satisfaction surveys.<\/li>\n<\/ul>\n<p><u>Compliance with legal obligations<\/u><\/p>\n<p>The Regulation on the Legal Profession (Verordening op de Advocatuur \u2013 Voda) and, in certain cases, the Dutch Anti-Money Laundering and Anti-Terrorist Financing Act (Wet ter voorkoming van witwassen en financieren van terrorisme \u2013 Wwft) require lawyers to record specific information about you. In addition, the Dutch General Tax Act (Algemene wet inzake rijksbelastingen \u2013 Awr) obliges us to process certain personal data. <\/p>\n<p>On the basis of this legal ground, we process your personal data for the following purposes:<\/p>\n<ul>\n<li>compliance with, for example, the Dutch Lawyers Act (Advocatenwet), the Regulation on the Legal Profession (Voda), the Anti-Money Laundering and Anti-Terrorist Financing Act (Wwft), the General Tax Act (Awr) and the General Data Protection Regulation (GDPR).<\/li>\n<\/ul>\n<p><u>Legitimate interests of K\u00f6ster Advocaten<\/u><\/p>\n<p>We may process your personal data where we have a legitimate interest and such processing does not result in a disproportionate infringement of your privacy. When relying on this legal basis, we carry out a balancing test for each processing activity and, where necessary, record this in our internal documentation. <\/p>\n<p>On the basis of this legal ground, we process your personal data for the following purposes:<\/p>\n<ul>\n<li>the recruitment and selection of new employees; and<\/li>\n<li>the improvement and optimisation of our website through the use of cookies.<\/li>\n<\/ul>\n<ol start=\"5\">\n<li>\n<h4><strong>With whom do we share personal data, and for what purposes? <\/strong><\/h4>\n<\/li>\n<\/ol>\n<p>We disclose your personal data to third parties only where this is required by law, necessary for the performance of our agreement with you, or required to protect our interests or the interests of third parties. For example, we may share your personal data with service providers (such as notaries, bailiffs and mediators) and other third parties (such as judicial authorities and arbitration institutes).<br>In addition, we make use of other third-party services, including digital services such as telecommunications services, internet services, applications for sharing or storing data (including servers), and applications that enable data to be searched, analysed, processed or translated, whether or not partially automated and\/or with the use of (intelligent) software.  <\/p>\n<p>Any disclosure of personal data takes place in accordance with this Privacy Statement. Third parties to whom we provide your personal data are themselves responsible for complying with the applicable data protection legislation. <\/p>\n<p>In certain cases, third parties process your personal data on behalf of K\u00f6ster Advocaten, for example providers responsible for our ICT infrastructure. Such third parties act as data processors. We enter into an agreement to regulate this processing of personal data (a data processing agreement) with these parties.   <\/p>\n<ol start=\"6\">\n<li>\n<h4><strong>How long do we retain your personal data? <\/strong><\/h4>\n<\/li>\n<\/ol>\n<p>We retain your personal data for as long as necessary for the purpose for which they were originally collected and\/or for as long as required to comply with our legal obligations. After this period, your personal data will be deleted. The following specific retention periods apply to certain categories of personal data:  <\/p>\n<ul>\n<li>files handled by K\u00f6ster Advocaten are retained for a maximum period of 20 years after closure, in accordance with the recommendation of the Netherlands Bar Association;<\/li>\n<li>as a general rule, we retain financial and administrative data for no longer than seven (7) years after the file has been closed; and<\/li>\n<li>Application data are retained for a maximum of four weeks after completion of the recruitment process. If you give us permission to retain your data for a longer period, we will keep them for a maximum of one year in order to be able to contact you regarding future vacancies. You may withdraw this consent at any time.  <\/li>\n<\/ul>\n<ol start=\"7\">\n<li>\n<h4><strong>How do we safeguard your personal data?<\/strong><\/h4>\n<\/li>\n<\/ol>\n<p>K\u00f6ster Advocaten takes all appropriate technical and organisational measures necessary to protect the personal data for which it is responsible against accidental or unlawful destruction, alteration or unauthorised disclosure.<\/p>\n<p>We apply internal policies and procedures (including IT security and data breach policies) to safeguard your personal data. Your personal data are accessible to our staff only where this is necessary. All of our employees are bound by confidentiality obligations, whether pursuant to professional rules or otherwise.  <\/p>\n<p>To safeguard your personal data, we have implemented, among other things, the following technical and organisational measures:<\/p>\n<ul>\n<li>Availability and continuity;<\/li>\n<\/ul>\n<p>We use our best endeavours to ensure a high level of availability and continuity of our website and systems.<\/p>\n<ul>\n<li>Device management and security;<\/li>\n<\/ul>\n<p>Only devices managed by K\u00f6ster Advocaten have direct access to our systems. Devices that are not managed by K\u00f6ster Advocaten can access our systems solely via a connection secured by passwords and two-factor authentication. <\/p>\n<ul>\n<li>Physical security;<\/li>\n<\/ul>\n<p>Our premises are secured by physical access control. Only authorised persons are granted access to our building. <\/p>\n<ul>\n<li>Autorisations;<\/li>\n<\/ul>\n<p>Access to our systems is secured.<\/p>\n<ul>\n<li>Encryption;<\/li>\n<\/ul>\n<p>Upon request, the exchange of data with you can take place using encryption.<\/p>\n<ul>\n<li>Monitoring of our systems;<\/li>\n<\/ul>\n<p>Our internal computer systems, including those on the computers made available by K\u00f6ster Advocaten to its employees, are continuously monitored for suspicious activity by a certified third party.<\/p>\n<ul>\n<li>Thread protection;<\/li>\n<\/ul>\n<p>Various systems have been implemented to prevent unauthorised access to and the disclosure of personal data.<\/p>\n<ul>\n<li>AVG-design;<\/li>\n<\/ul>\n<p>Any new system we intend to implement is tested in advance to ensure compliance with the principles of privacy by design and privacy by default.<\/p>\n<ul>\n<li>Data protection impact assessments;<\/li>\n<\/ul>\n<p>Before putting a new system into use, we will also subject it to a data protection impact assessment where this is required by law.<\/p>\n<ol start=\"8\">\n<li>\n<h4><strong>Transfer of personal data to countries outside the EEA<\/strong><\/h4>\n<\/li>\n<\/ol>\n<p>K\u00f6ster Advocaten processes your personal data in principle only within the European Economic Area (EEA). Where personal data are transferred to a country outside the EEA, this will take place only if the relevant country is subject to an adequacy decision of the European Commission, or where appropriate safeguards have been implemented, such as the use of standard contractual clauses (SCCs) approved by the European Commission, or other legally permitted transfer mechanisms. You may also contact the Dutch Data Protection Authority (Autoriteit Persoonsgegevens). <\/p>\n<p>If you wish to exercise any of these rights, you must submit a request using the contact details set out in this Privacy Statement. You will receive a response to your request within six weeks. We will only process requests relating to your own personal data. For this reason, you are required to include a copy of your identity document with your request. In doing so, you should obscure your photograph and your citizen service number (BSN).    <\/p>\n<p>We may not be able to comply fully with your request in all cases, for example where compliance would conflict with a legal obligation. If we are unable to honour your request, we will inform you of the reasons for this. <\/p>\n<p>K\u00f6ster Advocaten does not make use of automated decision-making, including profiling, as referred to in Article 22 of the GDPR.
